A TELEMARKETING class action lawsuit has been filed against a Major League Baseball team.

Thanks to the settlement, eligible Americans can score a $300 payment from the $1.225 million pot.

The Chicago Cubs have agreed to pay $1.225 million to settle claims they sent telemarketing texts to fans illegally.

The texts were centered on the baseball team's merchandise and were repeatedly sent despite fans' requests to opt out.

These messages constituted a violation of the Telephone Consumer Protection Act or TCPA.

Although the Chicago Cubs have not admitted to wrongdoing, the team agreed to pay individuals around $300 each to settle the lawsuit.

WHO'S ELIGIBLE

To qualify for the money, individuals must have been sent at least two marketing texts from the Cubs at least 30 days after sending a "stop" reply.

These texts must have been received in a 12-month period.

They also must have been received within four years of May 2, 2019.

Around 2,486 people are included in the settlement.

AUTOMATIC PAYMENTS

No action is needed to receive the payment.

Eligible class members who don't exclude themselves from the settlement will be automatically sent their payment.

The exclusion and objection deadline is approaching fast – class members have until May 14, 2024, to do so.

They will receive a notice in the mail or by email from settlement administrators.

Class members can update their address or choose a payment method on the settlement website.

People who don't choose a payment method will get a paper check sent to the address they received the notice.

If they receive their notice by email, they will receive an electronic payment instead.

The final approval hearing is set for June 17, 2024.
